Kryeprokurorja deklaron se ndërtimi i një procesi penal ndaj një zyrtari të korruptuar apo gjykimi i tij, nuk është i lehtë

Kryeprokurorja Ina Rama ka apeluar dje heqjen e imunitetit të deputetëve, për thjeshtimin e hetimit të tyre. Një vit pas funksionimit të një task-force hetimore në luftën ndaj korrupsionit, Ina Rama deklaron se rastet më të vështira janë hetimet e zyrtarëve.

“Të gjithë e dimë që ndërtimi i një procesi penal ndaj një zyrtari të korruptuar apo ndaj një biznesi të rëndësishëm është një proces jo i lehte së pari për shkak të specifikave të hetimit të këtyre lloj veprash penale dhe së dyti për shkak të peshës së personave apo interesave të prekura nga hetimi”, tha Rama. Ajo bëri apel për të kapërcyer këto pengesa në hetimin e zyrtarëve të lartë, në mënyrë që drejtësia të mos dështojë. “Po kaq i vështira na ka rezultuar përgjithësisht edhe procesi i gjykimit të kësaj kategorie veprash penale. Detyra jonë është të superojmë këto pengesa duke e konsideruar të gjithë punën tonë në këtë drejtim si një sfidë, që duhet fituar me çdo kusht përndryshe gjithçka kemi mësuar në studimet tona për drejtësi, gjithçka që kemi aspiruar në formimin tonë si individë, që kemi marrë përsipër të vendosim drejtësi, do të mbeten iluzione dështakësh, dhe ne nuk mund të pranojmë që kjo të ndodhë”, tha kryeprokurorja Rama. Ajo vlerësoi punën e Task Forcës për hetimin e korrupsionit gjatë vitit të parë të funksionimit të saj. Rama u shpreh se është vënë re një rritje e kallëzimeve penale nga qytetarët për veprat korruptive. “Është relativisht një kohë e shkurtër ajo gjatë se cilës njësitë kane filluar të funksionojnë realisht, por referuar statistikave shohim të dhëna shumë premtuese për shkak të punës së tyre. Që nga krijimi i tyre në vitin që shkoi janë rritur rastet e hetuara për veprat penale të cilat janë në kompetencë të njësive të përbashkëta. Vihet re në mënyrë të veçantë rritje e numrit të kallëzimeve të depozituara nga shtetasit për veprat penale kryesisht me natyrë korruptive”, u shpreh kryeprokurorja. Ajo theksoi se puna e njësive është konceptuar që në krijimin e tyre si puna e një skuadre. “Prokurorët dhe drejtuesit e njësive kanë për detyrë të bëjnë të ndjehen si anëtarë të një ekipi të gjithë pjesëtarët e njësive duke shfrytëzuar në maksimum kapacitet e tyre njerëzore në shërbim të detyrave që kanë marrë përsipër të kryejnë”, theksoi Rama. Ajo shtoi më tej se pavarësisht rezultateve pozitive, ka nevojë ende për shumë dhe për të evidentuar problemet që ekzistojnë për të përmirësuar atë që është bërë keq. “Pavarësisht angazhimeve te marra nga anëtarët e njësive, duhet më shumë punë, më shumë përkushtim, më shumë seriozitet në kryerjen e funksioneve, gjithmonë ka vend për përmirësim por, që ai të ndodhë duhet që problemet të evidentohen e të bëhen prezent përpara hallkave drejtuese të secilit institucion dhe të merren masat përkatëse për riparimin e tyre”, deklaroi kryeprokurorja. Ajo shtoi më tej se është konsideruar thelbësor në mirë funksionimin e këtyre strukturave bashkëpunimi institucional. Sipas Ramës një element i rëndësishëm në shërbim të mirëfunksionimit të punës së njësive, por edhe të ushtrimit me efiçencë të ndjekjes penale, është specializimi i anëtarëve të njësisë nëpërmjet trajnimeve të përbashkëta për njohjen në brendi të elementeve të këtij lloj kriminaliteti dhe mënyrës së goditjes së tij. “Përballimi me sukses i luftës kundër këtij lloj kriminaliteti kërkon njohuri të thelluara dhe vizion të qartë profesional, kërkon fillimisht të kuptosh një skeme korruptive apo një skemë pastrimi parash dhe pastaj të dish të kërkosh provat për ta provuar atë dhe në finale të arrish të bindësh gjykatën për atë qe ka ndodhur përmes një procesi përgjithësisht të vështirë dhe të komplikuar”, u shpreh kryeprokurorja. Rama theksoi më tej se nuk mund të ketë luftë efektive ndaj korrupsionit dhe krimit ekonomik pa besuar realisht në këtë kauzë. “Ushtrimi i ndjekjes penale në këto raste kërkon përkushtim dhe kurajo, kërkon profesionalizëm dhe vendosmëri, kërkon besimin e madh në vetvete se po lufton me armikun më të rrezikshëm dhe më destruktiv për vendin në këto momente”, tha kryeprokurorja.

Imuniteti, pengesë për hetimin e zyrtarëve të lartë
Prokuroria e ka pasur gjithmonë të vështirë të hetojë deputetë për shkak të imunitetit që ata disponojnë. Megjithëse ky institucion vë re pasuritë e mëdha të zyrtarëve të lartë dhe shtëpitë super të shtrenjta që ata disponojnë, nuk mund të ndërmarrë një proces hetimor ndaj tyre, për shkak të imunitetit. Dy rastet më të fundit të cilët i kanë shpëtuar hetimit të Prokurorisë, janë ish-ministri i Transporteve për dyshimet që u hodhën ndaj tij për korrupsion kolosal me rrugën Durrës-Kukës dhe rasti tjetër është ish-ministri i Mbrojtjes Fatmir Mediu i cili u akuzua se ishte shkaktar i shpërthimit të fabrikës së demontimit në Gërdec, që shkaktoi qindra viktima. Maxhoranca është shprehur e gatshme të heq imunitetin e deputetëve, kërkesë kjo e bërë edhe nga përfaqësuesit ndërkombëtar, por për të bërë të mundur një gjë të tillë duhen 84 vota, pra duhen e dhe votat e opozitës. Kështu për sa kohë opozita vazhdon të qëndrojë jashtë parlamentit, Prokuroria do ta ketë të vështirë të hetojë korrupsionin e zyrtarëve të lartë për shkak të imunitetit që ata gëzojnë.

Ministri i Financave Ridvan Bode, vlerësoi ritmet e goditjes së krimit ekonomik dhe pastrimit të parave, duke përmendur katër milion euro të bllokuara nga drejtoria e parandalimit të pastrimit të parave. “Gjatë vitit 2009 nga Drejtoria e Përgjithshme e Parandalimit dhe Pastrimit të Parave janë detektuar, analizuar dhe dërguar në organet ligjzbatuese 194 raste të dyshimta për pastrim parash dhe janë bllokuar mbi 4 milionë euro llogari dhe asete. Kjo përbën në vetvete një arritje të konsiderueshme, fakt që konfirmohet dhe nga veprimet procedurale të marra në vijim prej njësive të përbashkëta hetimore, siç janë rritja e numrit të çështjeve penale të filluara si dhe sekuestrimi i mbi 80 për qind të aseteve të bllokuara prej njësisë së inteligjencës financiare”, tha ministri i Financave Ridvan Bode, Gjashtë strukturat task-forcë, që funksionojnë që prej një viti në qytetet kryesore të vendit, paraprihen nga rezultate të larta të strukturës pranë Prokurorisë së Tiranës. Në takim merrnin pjesë edhe zv.drejtori i SHISH, Ylli Alushi, zv.ministri i Brendshëm, Avenir Peka dhe përfaqësues të strukturave të tjera në luftën kundër krimit ekonomik, korrupsionit dhe pastrimit të parave.

Avokati i dosjes “Gërdeci” arrestohet për korrupsion

TIRANË- Në pranga për korrupsion një avokat në Tiranë. Mësohet se bëhet fjalë për një nga avokatët e dosjes “Gërdeci”. Hysni Beti, u arrestua në zyrën e tij të avokatisë dhe mbi të rëndon akuza e ndryshimit të masës së sigurisë për një të arrestuar.

Sipas policisë, Beti do ndikonte tek gjyqtari për ti ulur dënimin, në këmbim të 5 mln lekë të vjetra. Emri i të arrestuarit që do favorizohej nga gjyqtari, nuk ka lidhje me dosjen “Gërdeci”.

Ndërsa në dosjen Gërdeci, avokati Beti ka marrë në mbrojtje ish-Dr. e Burimeve në Min.Mbrojtjes, Shkëlzen Madani.

Der Grüne Europa-Politiker Daniel Cohn-Bendit kritisiert Frankreich und Deutschland scharf…Der französische Regierungschef François Fillon und Staatschef Nicolas Sarkozy hätten dem griechischen Premier zugesichert, Gelder für ein Hilfspaket lockerzumachen - “aber Sie müssen die Rüstungsverträge weiterbezahlen, die wir mit Ihnen haben”, hätten sie ihm gesagt. Das heillos verschuldete Griechenland, das nun nur mit Hilfe seiner europäischen Partner dem Staatsbankrott entgeht, habe also Rüstungsverträge im Umfang von mehreren Milliarden Euro “bestätigen” müssen, sagte der Grün-Politiker. Als Gegenleistung für die europäischen Kredite müsse die griechische Regierung “französische Fregatten für 2,5 Milliarden, Hubschrauber, Flugzeuge und deutsche U-Boote” kaufen.

 

Kommentar: u.a. verkaufte man Griechenland 750 unsinnige Leopard Panzer und 4-U Boote und die Bestechungsfirmen wie Thyssen, Ferrstaal sind sowieso immer in diesen Lobby Betrugs Geschäften wie die KfW dabei. Die faulen Kredite mussten halt mal wieder gedeckt werden der Deutschen Bestechungs Firmen.

 

Man wusste also bestens Bescheid, aber trotzdem betreibt die verbrecherische FES und SPD heute mit den selben Leute unverändert eine Partnerschaft. Noch krimineller und korrupter geht es halt wirklich nicht mehr, im System hoch krimineller Deutscher Aussenpolitik, welche ins Abseits geführt hat. Man arbeiter vor aller Augen nur mit der Prominenz, der Balkan Mafia zusammen und besorgt diesen Leuten, Mercedes und VW Vertretungen zum Zwecke der Geldwäsche und der Auslands Bestechung. Und 750 Leopard Panzer, mussten genau die selben Leute, auch mit KfW Krediten, an das korrupte Griechenland verkaufen, wo alle Politiker direkt von den Deutschen Berufs Ganoven des Auswärtigen Amtes, wie auch im Kosovo finanziert werden.

Der Ex-General Staatsanwalt von Berlin (1995-2006) Dr.Hans-Jürgen Karge erklärt, warum die Weisungs gebundene Berliner Justiz, nicht gegen die Verbrecher Kartelle der Politik vorgeht. Schon damals versuchte man u.a. durch die Profi Verbrecherin SPD-Senatorin Karin Schubert und Berliner Justizsenatorin Karin Schubert, ermittelnde Staatsanwälte auszuschalten, was Geschichte ist. Zu tief ist die SPD in einen hoch kriminellen Sumpf verstrickt und Motor im Aufbau krimineller Netzwerke im Balkan und in Deutschland. Heute unternimmt die neue General Staatsanwaltschaft Nichts mehr gegen Politiker, sondern ist Partner des Verbrechens und der Organisierten Kriminalität in Berlin.

Zwei Ex-Bankchefs in Island festgenommen

Der Kollaps des isländischen Bankensystems vom Oktober 2008 erschütterte die Finanzmärkte bis ins Mark. Auch viele kleine Sparer hatten damals wegen verlockender Zinsen Geld in Island angelegt. Zwei hohe ehemalige Bankmanager wurden jetzt in der isländischen Hauptstadt Reykjavik festgenommen.

Die Griechische Schiffswerft für U-Boote, an der Thyssen beteiligt ist, hat noch 180 Millionen € Schulden an Deutsche Rüstungs Konzerne, welche wohl durch einen Verkauf an eine Dubai Investment Gruppe verkauft werden soll. Dubai ist die Geldwäsche Zentrale der Welt, wo anscheinend im Moment die Netzwerke zusammen laufen.

Unsere Deutschen Lobbyisten der Politik machen anscheinend nur diese Art von Geschäften, um Profi Bestechungs Firmen wie Thyseen, EADS und Co. Natürlich immer KfW und Hermes Kredite und Bürgschaften, welche dann wieder der STeuerzahler berappen darf.

Die Groß Marine der Griechen, in Internationalen Einsätzen und natürlich Weltweit!
Wohin eine Imperiale NATO Rüstungs und Besatzungs Politik halt führt.

Der Nato-Hubschrauber NH90 ist der modernste Helikopter der Welt: Seine Zelle besteht zu 80 Prozent aus leichten Kohlefaser-Verbundstoffen, sein Rumpf ist dank Stealth-Technologie für Radar schwer zu orten.

Als erster Hubschrauber überhaupt hat er eine vollständig computergestützte Fly-by-Wire-Steuerung. 122 dieser Super-Flieger hat die Bundeswehr bestellt – für insgesamt 4,6 Milliarden Euro. Wegen der aufwändigen Technik kam es schon in der Vergangenheit zu massiven Verzögerungen.

Arrest in Kosovo points to secret camps

 

International police in Kosovo have arrested a former guerrilla commander suspected of war crimes in a widening investigation that was spurred by our exposé of secret detention camps run by the Kosovo Liberation Army during and after the 1999 war.

Local media reported European Union police detained Sabit Geci on Thursday following a raid on his home in Pristina.

Witnesses have linked Geci and other KLA commanders to the torture and murder of prisoners at an operations base in the Albanian border town of Kukes.

A series of joint reports last year by CIR, the BBC and the Balkan Investigative Reporting Network detailed evidence of the abuses and killings following a multi-year investigation.

A wide range of sources—from survivors to former KLA soldiers—spoke of a network of secret camps scattered throughout Kosovo and Albania where civilians and POWs were held, tortured and sometimes killed.

In some cases the abuses allegedly occurred under the noses of UN officials and NATO troops, who arrived in Kosovo in June 1999.

We reviewed internal documents that showed United Nations officials knew about the allegations as early as 2002 but failed to launch a serious investigation. What’s more, officials at the UN war crimes tribunal in The Hague destroyed physical evidence that related to some of the allegations.

This is the first case of possible war crimes on Albanian soil and it could lift the lid on Albania’s covert support of the KLA and links to wartime abuses.

Sources close to the investigation say the government of Albania refused to cooperate with EU prosecutors despite an earlier pledge to help international investigators looking into the allegations.

There’s been no reaction from Kosovo’s current leadership, which is dominated by former KLA commanders. But here’s what Kosovo’s prime minister and former KLA political director Hashim Thaci told us last year when pressed about the Kukes allegations.

“It just didn’t happen,” Thaci said. “At any time, in any case, in any place, any space —this has nothing to do with the Kosovo Liberation Army.”

I spoke about these developments today with Marco Werman on PRI’s The World.

The man spoke plainly as he explained the horrors he lived through in a Kosovo Liberation Army prison camp 10 years ago. He told me about how he watched people beaten with steel pipes, cut with knives, left for days without food, and shot and killed.

“What can you feel when you see those things?” he said. “It’s something that is stuck in my mind for the rest of my life. You cannot do those things to people, not even to animals.”

As the man talked, his mother paced nervously in the nearby kitchen. She was panicked and tears were streaming down her face.

“They’ll kill him, they’ll kill him,” she moaned, clutching one of her grandchildren.

But her son persisted. We spent hours in the family’s sitting room as our source detailed allegations of possible war crimes by KLA officers in a military camp in the Albanian border town of Kukes.

It was a crucial interview for a delicate story I have been investigating for years.

Mystery of the missing

Soon after the war ended in Kosovo, I started looking into the thousands of civilians who disappeared during and after the conflict. Many Albanian victims were dumped in wells or transported to mass graves as far away as Belgrade.

But others - mainly Serbs - simply vanished without a trace. There were no demands for ransom, no news of any kind.

I had met sources who spoke vaguely about secret camps in Albania where Kosovo Serbs, Albanians and Roma were interrogated, tortured and in most cases killed.

I met another source who agreed to share important details about KLA prison camps. This man cut a very different profile.

He had returned from a successful career abroad to join the KLA in its fight for Kosovo’s independence from Serbia.

The man was still proud of the goals he fought for, but he had become haunted by the treatment of civilians he had seen at a KLA prison camp. More than that, he said he felt angry and betrayed by KLA commanders who tolerated and even ordered the abuses.

“It didn’t seem strange at the time,” he told me as he described seeing desperate civilians locked in a filthy agricultural shed.

He said the civilians were Serbs and Roma seized by KLA soldiers and were being hidden away from Nato troops. The source believes the captives were sent across the border to Albania and killed.

Did the UN destroy more war crimes evidence?

A scandal is brewing at the United Nations over the possible destruction of thousands of items of evidence and artifacts recovered by UN war crimes investigators in the Balkans.

I reported several weeks ago for the BBC about how the UN had apparently mishandled evidence of possible war crimes by Kosovo Albanian guerrillas during and after the 1999 war. (See CIR web-exclusive video journals of my reporting trip here.)

My report revealed that officials at the Hague-based UN war crimes tribunal for the former Yugoslavia (ICTY) had destroyed physical evidence at the center of an investigation into allegations of organ harvesting. The material included used medical supplies—drug vials, syringes and IV drip bags—discovered in 2004 by a UN team during a search of a house in central Albania. The team was investigating allegations that civilians captured in neighboring Kosovo by operatives from the Kosovo Liberation Army were taken to the house, subjected to organ harvesting and then killed.

Prosecution closing in on big Kosovo cases

BELGRADE — War Crimes Prosecutor Vladimir Vukčević said that the prosecution is on the brink of a major discovery in cases related to Kosovo criminal activity.

“At this moment, I can only say that these pieces of evidence will make the process-legal situation in several Kosovo cases a lot easier,” Vukčević told daily Blic.

He said that the recently arrested former KLA commander Sabit Geci was a very important figure in the chain of command of the Kosovo Liberation Army and secret police.

“He is a man who is mentioned in many cases of organized crime. We are in constant contact with EULEX and we helped them a lot in this case,” Vukčević said.
