The Kosovo government has announced plans for a major highway to run to the Albanian border at Prizren. Negotiations are set to begin with the American-Turkish Company, Bechtel-Enka Joint Venture. The company has already built a 65km roadway in northern Albania.

“Kosovo will have easier access to the world markets; the movement of people will be easier … as well as the access to the harbours,” said Kosovo Prime Minister Hashim Thaci. “Kosovo will have access to the sea [via Durres, Albania] through this highway.”

Specifics about the highway — cost, length and exact route – will not be known until negotiations with Bechtel-Enka are complete, though it is estimated to run some 118km and include exits at Pristina International Airport. It will also give Kosovo access to the Adriatic Sea.

Kosovo RTV21 quoted the transportation spokesman Xhevdet Pozhari confirming that negotiations with Bechtel-Enka began last week. Pozhari said many technical issues will be discussed, including the method of construction and its impact on the Kosovo economy.

The road is expected to roll through eight municipalities and cover 1,062 hectares of land, according to the Kosovo news agency Ekonomia.

To reduce costs and avoid unnecessary problems, the highway route has been changed to avoid heavily mountainous areas. It will run from Pristina to Vermica, at the border with Albania, and from Pristina to Merdare, a crossing point on the border with Serbia.

Thaci told local media that Kosovo would greatly benefit from the project because the connection will open a variety of European corridors, while creating construction jobs.

The biggest public project in the county’s history, the highway is expected to take about three years to build.

On January 19th, Reuters reported that the Turkish builder and power company Enka Insaat and the American engineering firm Bechtel “had been named preferred bidders by Kosovo for a 103km highway project”.

The report quoted Kosovo officials as estimating that the highway could cost 800m euros. The news that Enka Insaat had won the contract prompted the company’s stock to jump 2.1% to 3.5 euros.

Kosovo Minister of Transportation Fatmir Limaj said that officials “are still negotiating details before signing a final agreement”, the AP reported.

Last May, the Kosovo parliament passed a law on taking private property — expropriation — for public use.

A recently opened highway with a tunnel blasted through the mountains of northern Albania has been troubled almost from the start, a headache that Kosovo hopes to avoid with the new project.

The four-lane, 170km highway opened in the summer of 2009, but part of the tunnel collapsed about four months later. The Albanian side of the tunnel is expected to reopen in March.

Pristina wants to avoid a repeat of that problem by going around the mountains in the Qafa e Duhles area, Limaj said last month.

However, all has not been without potholes. Opposition parties have accused the government of rerouting the highway for a variety of reasons, including charges that they want it to pass through Limaj’s hometown. In defense of the route, Limaj said the highway will allow “Kosovo and its economy [to] no longer be a victim of various limitations.”

The government has also been criticized for delaying the start of work on the highway. Thaci said in an interview with the Kosovo financial daily Eko Biznesi that groundbreaking had been prolonged. He added that the government has continued to survey more than a dozen zones along the highway route for property boundaries, ownership and title.

Who will pay for the highway remains unanswered. The daily paper Kosova Sot reported on January 20th that banks in America and Germany along with Overseas Private Investment Corporation Bank have been mentioned as possible lenders.

Belgrad and the problems with the Gazela Bridge

BELGRADE — The parliament’s Committee on Transportation and Communications will discuss problems caused by the damage discovered on the Gazela Bridge in Belgrade.

A request for the session was sent to the parliament speaker by the opposition Liberal Democratic Party (LDP), which stated that this was an opportunity to define deadlines and obligations in order to start a complete reconstruction of the bridge as soon as possible.

The city’s busiest bridge spans the Sava River, connecting Belgrade and New Belgrade.

Due to the cracks on the bridge’s main pier, traffic in the central lane toward New Belgrade was stopped last weekend, while trucks and other freight vehicles have been rerouted to other roads.

According to announcements, until next week, the freight traffic will be redirected to the reconstructed Straževica tunnel which connects the Belgrade-Niš highway with the Ibarska road.

Meanwhile, Deputy Infrastructure Minister Dragan Jovanović claims that all the repair works will be finished in seven days’ time, and adds that “nobody is responsible for this situation”.

“The crack in the tin sheet is not a special defect, similar changes have happened before,” he said, and pointed out that such defects are detected and repaired during regular controls.

“This happened during the bridge’s exploitation. Workers of the public enterprise Roads of Serbia (PJ Putevi Srbije), who are in charge of maintenance, have done their job remarkably conscientiously and what happened is a real example of how it should be done,” Jovanović stated.

Regardless of the fact that the crack which appeared on the surface layer of the bridge last week does not endanger the safety of people or transport, the deputy minister said that there is no room for postponing a comprehensive reconstruction of the 40-year old bridge.

“We have been waiting year after year and that’s how it came to this. In any case, what has been planned must be done this year,” Jovanović said.

He said that the European Bank for Reconstruction and Development (EBRD) must change its condition related to the dislocation of a makeshift Roma community from under the bridge, in order for Belgrade to agree to the loan conditions.

Đilas told B92 that a clause in on the dislocation of the settlement, that calls for apartments for the Roma to be built, was accepted without much consideration, and added that the construction of those apartments would cost EUR 5mn.

“This is not a donation, but an economic loan, and if these are the conditions, we will not take it,” Đilas said, adding that this was not acceptable for the city, since the EUR 33mn loan would have an interest rate of 25 percent, rather than five, attached to it.

He said that the Roma that were moved out of the unhygienic communities under the bridge are now living under significantly better conditions and will be able to compete for getting new apartments through social services.

Đilas said that it was suggested to the EBRD that conditions of the loan be considered by March 15, and that a meeting should be held next week with officials of this financial institution, adding that a decision on the loan “could come earlier than expected”.

“If no agreement is reached, we will take out the loan from commercial banks,” Đilas said, adding that the city of Belgrade wants to be the main carrier of the Gazela project if it ends up co-financing it, so that there would be no delays in the restoration of the bridge.

Albania’s constitutional court has annulled a controversial lustration law that targets former communist regime collaborators. The law had come under harsh criticism from the country’s association of prosecutors and judges as well as from western capitals, while the United States embassy in Tirana asked the government to redraft it.Critics said that the law was unconstitutional because it allowed a special commission to fire judges and prosecutors who served during the former communist regime without due process in the judicial system.

The commission did not need to prove the officials were guilty of any crime, and the opposition said that this allowed the government to fire prosecutors investigating high-profile corruption cases.

If put into force the law could have wiped out half of Albania’s supreme court and constitutional court, throwing the justice system into crisis.

The Council of Europe also expressed concern with the law, arguing that it raised serious human rights questions.

“I have some concerns that the lustration law adopted by the Albanian Parliament does not comply with Council of Europe standards of democracy, human rights and the rule of law,” General Secretary Terry Davis said in a statement.

An analysis of the law by Council of Europe experts revealed several issues to be reconsidered, including the very broad reach of the law in terms of the categories of officials affected, the fact that it includes people currently in office, the fairness and proportionality of the lustration proceedings, the severity of the sanctions foreseen and the fact that there is no time limit on the law.

Prime Minister Sali Berisha, who called the bill “a historic victory against political crime” when it was adopted in parliament, has brushed off the criticism. He argues that the court is not competent to review the law because some of its judges served on the bench during the communist regime.

“Every lustration law has its critics, but I respect the moral standard of the law,” he said, responding to the Council of Europe statement.

Berisha has accused the constitutional court of having a conflict of interest with the law and said that it was thus not competent to deliver a judgment on it.

Bosnian police have launched a massive search operation in the northeastern part of the country on Tuesday, targeting a remote village, prosecutors said. The police are searching for “items and evidence of criminal activity”.

Some 600 officers from a number of different Bosnian law enforcement agencies have begun a search of the village of Gornja Maoca and surrounding areas to locate persons suspected of threatening the country’s “territorial integrity, constitutional order and provoking inter-ethnic and religious hatred,” a statement issued by the Prosecutor’s Office of Bosnia read.

Officers of the European Union police mission in Bosnia are also taking part in the operation, dubbed “Light”, which is being conducted in the village of Gornja Maoca “in search of items and evidence of criminal activity,” it added.

Prosecutors said that this was the largest police operation in Bosnia since the end of the country’s 1992-95 war.

The police have already found “certain quantities of weapons”, a spokesman for the prosecutor’s office told Balkan Insight without elaborating. Boris Grubesic was speaking from the northern town of Brcko where the operation headquarters have been set up.

The village of Gornja Maoca has repeatedly been described by local media as home to devout hardliners living in a state of virtual isolation without access to TVs, phones or any other modern appliances.

Media suspected the villagers, who reportedly follow the radical interpretation of Islam known as Wahhabism, of terrorist links, accusing them of using the village as a training camp for attacks against western targets.

The village has been kept under close watch by police for several years.

The news of the savage attack on newspaper editor Mero Baze by Rezart Taci and his “bodyguards” marked a sad day in the history of Albania’s democracy.  This is because this heinous act was a direct assault on the most fundamental principal of democracy - freedom of speech.  Although it’s a positive development that Taci has been arrested, it is easy to have doubts that he will be prosecuted to the fullest extent of the law when one considers his ties to the Berisha family and Berisha’s past attempts to undermine other investigations, like those of his capos Lulzim Basha and Fatmir Mediu.

 

But there could be a silver lining to this cloud.  With the arrest of Taci - which would not have occurred without the massive international pressure placed on Sali Berisha - the opportunity now exists for the prosecutor to re-open the book on the ARMO deal and Taci’s dealings with the Berisha family.   However, if there is any hope of accomplishing this objective the US and EU must continue to apply pressure on the Albanian government to avoid any predictable attempts by Berisha to try to bury the whole affair under a rug.  It is encouraging that Ambassador Withers* spoke in a highly critical manner about this vulgar act during his conference with Albanian journalists that included Mero Baze, but the Ambassador should know by now that in Albania issues like this often end up sinking into the sand unless there is continuing focus on the problem by American and European interests.

 

Below are several messages I distributed in 2008 about ARMO.  Patton Boggs, a well known Washington law firm, advised the Albanian government with respect to the ARMO privatization.   When the original tender process for ARMO was concluded, as many will recall, Jude Kearney, an attorney with Patton Boggs, appeared in an interview in Tirana that was televised on Voice of America in which he declared that the bidding for ARMO was transparent.  At that time Refinery Associates of Texas, a relatively obscure American company, was announced as the successful bidder.  Yet somehow, between the time of Mr. Kearney’s talk of transparency  and the closing of the deal, it appears ARMO ended up under the control of Rezart Taci.  Based on what just happened to Mero Baze, in my opinion, Taci looks to be just another Deligjorji type thug who takes orders from Sali Berisha. I find it more than an odd coincidence that Milhal Deligjori and Rezart Taci are both clients of Argita Berisha’s law firm.**

 

Taci’s attack on Baze now raises numerous questions.  Why hasn’t there been an outcry over ARMO landing in Taci’s hands?  How much was actually paid for ARMO and what was the source of financing?   In addition to the cost of the acquisition, the winning bidder was supposed to invest an additional $250 million to improve ARMO’s operations.  Has Taci made any of the required investments?  I asked many of these questions at the time the ARMO deal was done, but to my knowledge they remain unanswered.  In my opinion, the whole ARMO tender process should be investigated, and if there were any improprieties or if Taci has failed to live up to the terms of the agreement, then ARMO should be ripped from his hands and re-tendered.  But this time there should be a truly transparent tender process that avoids any possible conflicts of interest with Berisha family members or the Meta/Prifti mafia.  Speaking of Dritan Prifti, what is behind his efforts to get the tax collector off of Taci’s back?  Do Prifti and Ilir Meta expect anything from Taci for this “accommodation?”  How have Meta and Prifti financed their exorbitant lifestyles? As I have offered in the past, I would be more than happy to offer my services gratis to provide consultation on these matters.

 

The previous attempts by friends of Berisha to censor Mero Baze and other journalists, including one from The New York Times, were all designed to stop criticism of the Berisha government through various forms of intimidation.  Unfortunately, members of the media have complicity in this regard because many have remained silent in the face of these attempts to prevent open criticism of Berisha and his friends.   Hopefully, the attack on Mero will serve as a wake up call in Albania so that more journalists will be willing to stand up and express their true opinions without fear of retribution from the government.

 

If the Berisha government has allowed the likes of Rezart Taci to grab assets of the state, then helps him to avoid paying taxes and then attempts to physically silence any of his critics it has a closer resemblance to a mafia enterprise than a democratic government working for the people.  If the international community and the prosecutor’s office fail to give Taci’s actions the full scrutiny they deserve, then they will share responsibility for allowing Albania to take a disturbing step backward in time.

 

I remind everyone that Kosta Trebicka served as the whistle blower on the illegal AEY arms deal (as reported in a front page article in The New York Times  http://www.nytimes.com/2008/03/27/world/asia/27ammo.html?_r=1&scp=3&sq=aey%20and%20trebicka&st=cse   ) that resulted in the conviction of three Americans by the Department of Justice for defrauding the U.S. government.   Kosta was killed in a suspicious “car accident” on a remote road in Albania, and many, including this writer, believe he was silenced forever for speaking out against the Berisha government.   Given Taci’s aggression against Mero Baze, it’s easy for me to imagine that Taci-like thugs with ties to Sali Berisha know more about the fate of Kosta Trebicka than has been told.

Fatmir Mediu: Friends and partner of drug boss:  Gazmend Mahmutaj

Defense Minister Mediu and Gazmend Mahmutaj to USG officials at relevant agencies.  Mahmutaj was arrested in Italy in 1998, and it was reported in Albania that Mediu was also arrested while traveling with him at that time.  It is alleged that Mahmutaj was traveling under an alias as part of Mediu’s entourage and that Mediu may have assisted Mahmutaj with this subterfuge.  Mahmutaj was reputed to have been wanted on charges related to drug and/or human trafficking at that time.  Mahmutaj was subsequently convicted and is serving a term in an Italian jail, and this was confirmed  by a major American newspaper.  Apparently, Mediu was either acquitted or plea bargained, but you should be able to confirm this yourself.  Kassem Mahumutaj, the brother of Gazmend, was appointed head of the Berat branch of Albania’s Republican Party, the political party for which Fatmir Mediu serves as Chairman, and one would have to stretch the imagination to believe this is just a coincidence.  Furthermore, when Mediu became Defense Minister, he appointed Kassem Mahmutaj as Director of the largest ammunition depot in Albania which fed ammunition into the Gerdec demil facility (the site of the tragic explosion on March 15, 2008 that resulted in the death of 27 people and injured hundreds of others) and also believed to have supplied a portion of the AEY contracts.  AEY is now under investigation by USG and Congressional committees for possible violations of statues related to arms transfers and the Foreign Corrupt Practices Act.  Mediu and Sali Berisha have been implicated in the AEY deal  as reported in The New York Times (   http://www.nytimes.com/2008/03/27/world/asia/27ammo.html?_r=1&scp=5&sq=albania&st=nyt&oref=slogin        ) .  You should also be aware that Fier, Mediu’s hometown, is  known in Albania as a base of operations for drug traffickers and human traffickers who forced women into prostitution in Western Europe, and Gazmend Mahumtaj was a reputed gangster who operated in this region.   According to a report issued by DOS today  (http://www.state.gov/g/tip/rls/tiprpt/2008/ ),  Albania continues to be a source for girls who are trafficked for the purpose of commercial sexual exploitation and forced labor and the report states the Albanian government “has not demonstrated that it is vigorously investigating or prosecuting complicit officials.”

As for the reason behind the abduction and torture, local media have alleged that Hoxha was witness to a conversation in Macedonia between then President Sali Berisha and former Serb strongman Slobodan Milosevic, in which they agreed to terms for smuggling oil during the 1992-1995 Bosnia war.  Berisha has declined to comment on the allegations; however, in 2005 he admitted “tolerating” the smuggling trade between Albania and Montenegro on the basis the trade was necessary for “humanitarian reasons” to relieve Montenegro and Kosova of the hardships of the UN embargo.  In reality, this illicit oil trade was conducted to evade the embargo for profit and ultimately, to support Serb military operations.  The source of the oil was Greece and it was transited through Albania into Kosova and beyond via truck; however, there may have even been some form of rudimentary pipeline network at border points.  Mediu was also rumored to be involved in this oil smuggling business as was Azem Hajdari, a member of Berisha’s Democratic Party who was  gunned down in front of Berisha’s Democratic Party headquarters.

As an aside, it was well known in Albania that the Top Channel TV station was one of Berisha’s harshest  critics, and he used any and all means to attempt to silence this Albanian media outlet.  Then, last year, Berisha strong-armed Top Channel by having the tax authorities threaten them with closure for non-payment of taxes, and Top Channel was not given the any opportunity question the claims of the tax authorities.  This was a successful effort by Berisha to block free speech because Top Channel immediately changed its tune.  In my opinion, anyone who now assists Berisha, directly or indirectly, to take control of the Top Channel  media group should be seen as a participant in a scheme to further suppress free speech in Albania.  Another example of this form of blatantly anti-democratic, dictatorial behavior occurred last November when then Defense Minister Fatmir Mediu sent goons to confiscate the video equipment of a New York Times reporter.  

As a precaution, please be advised that this message has been blind copied to DOJ and relevant members of Congress who are investigating the AEY arms deal with Albania.  This is because I believe those investigating this matter should be made aware of any parties who may be advising the Albanian government on these issues in any way, even if there is no suspicion of wrong doing by such parties.  This is due to my belief that Sali Berisha and co-conspirators, which may include his family members and other Albanian government officials, are operating what is in reality a vast criminal conspiracy.  Up until the revelation of the AEY deal, certain USG agencies have been willing to look the other way as a result of Albania’s cooperation with other matters, but now the Berisha government may have crossed a line if they facilitated illegal transfers of arms to USG, provided sub-standard ammunition to DOD and/or diverted millions of dollars in payments to a straw company in Cyprus.  If proven, these crimes would constitute abuse of DOD procurement programs and American tax payers.

According to an AP report about a UN report released last Thursday about crime in the Balkans (  http://ap.google.com/article/ALeqM5hb7aJHGOQd4YCTWF8hWeO8dsIa7QD90VEJT80    ),  “Albania has the worst crime in the region and remains the ’soft underbelly’ of the Balkans for mafia rings.”  The AP report also stated, “Costa (Antonio Maria Costa, Executive Director of the UN Office on Drugs and Crime) warned that organized crime - and its links to politicians and business - continues to pose serious challenges in several Balkan nations.”  There should be no doubt that the primary Balkan nation she is referring to is Albania - a client of Patton Boggs.

FYI - Below is my letter to Patton Boggs, the Washington law firm that served as advisor to the Albanian government for the privatization of ARMO, Albania’s state-owned oil refining company.  Also, this link contains info on Refinery Associates of Texas, the winning bidder, which is reported to have completed several supply contracts with DOD   http://www.gasandoil.com/goc/company/cnm71322.htm (including one displacing Halliburton for the  supply of oil to U.S. Army Corp of Engineers in Iraq).   From what I can ascertain, it seems that RAT is primarily an oil brokerage firm, but I couldn’t find information that indicates it has operating experience withrefining facilities.  One could surmise that there’s a pattern emerging of companies that have just a handful of employees (AEY, RAT) yet have been awarded hundreds of millions of dollars in contracts by both the Pentagon and the Albanian government.

Beide festgenommenen haben wohl die Mailand Drogen Schiene nach der Festnahme von H.Hoscha und Shabani übernommten, weil Beide verwandt mit dem Politiker undEx-Verteidigungs Minister Fatmir Mediu RP Partei sind. Beide sind auch Chef Organisatoren im Italienischen und Internationalem Frauen Handel.

Straßburg, 09.12.2009 – Die Staatengruppe gegen Korruption des Europarates (GRECO) hat heute ihren Evaluierungsbericht der dritten Runde über Deutschland veröffentlicht (Thema I – Strafrechtliche Verfolgung, Thema II – Transparenz der Parteienfinanzierung), nachdem die deutschen Behörden ihre Genehmigung erteilt haben. Der Bericht stellt zwei getrennte Themen in den Mittelpunkt: Strafrechtliche Verfolgung von Korruption und Transparenz der Parteienfinanzierung. Die wichtigsten Schlussfolgerungen sind folgende:

Die mit der Untersuchung und strafrechtlichen Verfolgung von Korruption in Deutschland befassten Personen unternehmen wirkliche Anstrengungen, um die ihnen derzeit zur Verfügung stehenden rechtlichen Mittel bestmöglich zu nutzen. Doch trotz Deutschlands wirtschaftlicher Kraft unterliegen die rechtlichen Mittel für die Untersuchung und strafrechtliche Verfolgung von Korruption bestimmten Einschränkungen, wenn es um grenzüberschreitende Formen von Korruption geht.

Es ist bedauerlich, dass der deutsche Bundestag es in der letzten Legislaturperiode nicht geschafft hat, den Gesetzesentwurf zur Überarbeitung der Bestimmungen zur Bekämpfung von Korruption zu verabschieden. Dieser Gesetzesentwurf wurde im Jahre 2007 vorgelegt und hätte Deutschland in die Lage versetzt, das Strafrechtsübereinkommen über Korruption (SEV 173) und das Zusatzprotokoll (SEV 191) sowie das Übereinkommen der Vereinten Nationen gegen die Korruption zu ratifizieren.

Besonderen Anlass zur Sorge gibt die Tatsache, dass bestimmte Gruppen von Personen unter eingeschränkte Bestimmungen zur Bekämpfung der Korruption fallen. Dies könnte in der breiten Öffentlichkeit den Eindruck hervorrufen, dass Teile der deutschen Gesellschaft nicht denselben Rechtsregeln wie der Rest der Bevölkerung unterliegen, wenn es um die Bewahrung der Integrität bei den sozialen, politischen und geschäftlichen Beziehungen geht.

Die GRECO fordert Deutschland auf, die bestehenden rechtlichen Bestimmungen zur Bekämpfung der Korruption zu ergänzen, und zwar im Hinblick auf die Ausweitung der strafrechtlichen Verfolgung der aktiven und passiven Bestechung von Parlamentariern, ausländischen Beamten und auf internationaler Ebene angestellten Personen. Die GRECO fordert die deutschen Behörden auch auf, ihre Strafverfolgung bei Bestechung in der Privatwirtschaft auszuweiten, die unerlaubte Einflussnahme strafrechtlich zu ahnden und die Regeln für die gerichtliche Zuständigkeit in Deutschland für Korruptionsstraftaten zu harmonisieren und auszuweiten.

Deutschland hat ein liberales Modell für die Finanzierung politischer Parteien gewählt. Doch hat das [deutsche] Gesetz über die politischen Parteien zu einem großen Teil die Empfehlung Rec(2003)4 des Ministerkomitees an die Mitgliedstaaten über gemeinsame Regelungen zur Bekämpfung der Korruption bei der Finanzierung politischer Parteien und von Wahlkampagnen des Europarates umgesetzt. Auf dieser Grundlage muss die deutsche Gesetzgebung nur angepasst werden, um besser mit Wählerverbänden umzugehen.

Auch muss die zunehmende Praxis des Sponsoring erneut überprüft werden. Darüber hinaus steht trotz unbestreitbarer Anstrengungen zur Stärkung der Transparenz der finanziellen Tätigkeiten von politischen Parteien die relevante finanzielle Information der breiten Öffentlichkeit nur nach beträchtlichen Verzögerungen von bis zu zwei Jahren zur Verfügung.

Die vom deutschen Bundestag ausgeübte Überwachung gibt Anlass zu großer Besorgnis vonseiten der GRECO. Es besteht die dringende Notwendigkeit einer Überprüfung der Situation von Abgeordneten im Hinblick auf die Finanzierung ihrer politischen Tätigkeit und ihre Unterwerfung unter strengere Regeln bezüglich des Erhalts von Unterstützung aus privaten Quellen (insbesondere aufgrund der aktuellen Lücken bei der strafrechtlichen Verfolgung von Korruption bei Parlamentsmitgliedern).

Der Bericht richtet insgesamt 20 Empfehlungen an Deutschland. Die GRECO bewertet die Umsetzung dieser Empfehlungen in der zweiten Hälfte des Jahres 2011 mittels ihres Sonderverfahrens für die Einhaltung der Empfehlungen.

Europarat sieht schwere Mängel bei Korruptionsbekämpfung

Deutschland sollte im Kampf gegen die Korruption von Politikern und internationalen Beamten nach Einschätzung der Staatengruppe gegen Korruption des Europarates Greco schärfer durchgreifen. Bei den nationalen Abgeordneten ist den Experten eine “außerordentlich beschränkte Definition von Korruption” aufgefallen, die lediglich den “Kauf oder Verkauf von Stimmen bei Wahlen” einschließt. Auch an der Parteispenden-Regelung gibt es Kritik.

Der Mafiös aufgebaute Politische Bestechungs Apparat in Deutschland mit einer Weisungs gebundenen Justiz

Ja. Der Bundesgerichtshof selbst hat im Dezember 2007 anlässlich eines Urteils im Kölner Müllskandal festgestellt, dass die Justiz für Fälle hochrangiger Wirtschaftskriminalität nicht angemessen ausgestattet ist, deswegen werde gegen solche Wirtschaftskriminelle zu selten ermittelt, Ermittlungen dauern zu lange und können nicht zuende geführt werden, Straftaten verjähren, täterschonende Deals wie im Falle des Deutsche Bank-Chefs Ackermann nach der Fusion von Mannesmann/Vodafon dienen als Ausweg. Der BGH hat damals dem Gesetzgeber und der Regierung aufgetragen, die Justiz personell und technisch besser auszustatten – seitdem ist nichts passiert.

Ist hier die Weisungsabhängigkeit der Staatsanwaltschaft, der Polizei und Finanzämter von Bedeutung?

Werner Rügemer: Weisungsabhängigkeit in Verbindung mit Personalknappheit und Parteibuchwirtschaft. Leitende und Generalstaatsanwälte werden mehrheitlich nach Parteibuch und Parteienproporz berufen. Auch die Mitgliedschaft von leitenden Staatsanwälten in Rotaryclubs kann durchaus eine Rolle spielen; das zeigte sich etwa im Fall der Bochumer Staatsanwältin Lichtinghagen. Sie leitete die Ermittlungen bei den vermögenden Steuerhinterziehern wie dem Postchef Zumwinkel und deren Liechtensteiner Stiftungen: Frau Lichtinghagen wurde abberufen und an ein Amtsgericht versetzt.

“Private Kapitaleigentümer haben alle Rechte”

Dass die Regierung von Roland Koch in Hessen Steuerfahnder, die ebenfalls die Fälle von vermögenden Steuerhinterziehern gesetzeskonform bearbeiten wollten, sogar mithilfe von psychiatrischen Gefälligkeitsgutachten hinausgemobbt hat, hat in den regierenden Kreisen und bei der Wirtschaftselite keinen Protest erregt – obwohl man hier ansonsten geläufig den Rechtsstaat beschwört.

Wie ist es in der Ära der Bagatellkündigungen und der Bankenrettungsschirme um das Verhältnis von Kapital und Arbeit bestellt?

Werner Rügemer: Vereinfacht gesagt: Die privaten Kapitaleigentümer haben alle Rechte einschließlich des “Rechts”, das geltende Recht zu brechen bzw. brechen zu lassen, und sie haben den Zugriff auf die staatlichen Gelder, während Beschäftigte und Arbeitslose immer mehr dem verrechtlichten Unrecht unterworfen werden.

Wie verträgt sich die juristische Ungleichbehandlung mit unserer Verfassung?

Werner Rügemer: Gar nicht. Artikel 1 des Grundgesetzes lautet: “Die Würde des Menschen ist unantastbar. Sie zu achten und zu schützen ist Verpflichtung aller staatlichen Gewalt.” Hier steht also nicht, dass die Würde des privaten Kapitaleigentümers unantastbar sei. Weiter wird bei den unveräußerlichen und unveränderbaren Grundrechten z.B. die “freie Entfaltung der Persönlichkeit” und die “körperliche Unversehrtheit” gefordert (Artikel 2), die Gleichheit vor dem Gesetz (Artikel 3), Unverletzlichkeit des Post- und Fernmeldegeheimnisses (Artikel 10), freie Wahl des Arbeitsplatzes und Verbot der Zwangsarbeit (Artikel 12). Alle diese Rechte werden für die abhängig Beschäftigten und Arbeitslosen systematisch verletzt. Natürlich muß auch Artikel 14 herangezogen werden: “Eigentum verpflichtet. Sein Gebrauch soll zugleich dem Wohle der Allgemeinheit dienen.”
