Montenegro to Reform Property Law

21 December 2007 Podgorica _ Montenegro’s government has adopted a draft law on property relations that will make it possible for the first time for foreign citizens, as individuals, to buy real estate in the tiny Adriatic state.

Until now foreigners were only able to acquire property in Montenegro if they registered a company - typically in partnership with a local one – in the country.

Under the planned legislation, which codifies property relations on the basis of international standards, such restrictions will be removed.

The proposed law also makes it possible to acquire a mortgage on a property that is under construction.

Previously mortgages were available only to those who wanted to buy a home that has already been built.

“That is a good step forward that will provide for the further dynamic development of the construction sector,” Minister of Finance Igor Luksic said after the government meeting.

The Montenegrin administration expects that the removal of restrictions on foreign nationals’ right to acquire property will improve Montenegro’s competitiveness and encourage further investment.

In recent years Montenegro’s resort have attracted many foreign investors, particularly from Russia and Britain.

The Wrong Sort of Business Boom

20 December 2007 Geography, market forces and inadequate police resources have all conspired to make smuggling one of Sandzak’s biggest commercial successes.

In a café, near the Tabalije checkpoint, at the administrative border between Serbia and Kosovo, the air is thick with cigarette smoke. Guests sip Brazilian coffee with Brazilian sugar and nibble slices of Brazilian prosciutto – all of which arrived here illegally.

The area around the café is peaceful during the daytime, but after dark the nearby forest is inundated with smugglers. Oil, food, cutlery, and household appliances are just a handful of the contraband that passes through.

In the area between the Serbian and UNMIK police checkpoints there are roads leading up to the hills and to Ribarici Lake. On rainy days it is easy to see the marks left by heavy lorries and off-road vehicles. The roads are controlled by smuggling gangs which often clash over the right of passage.

In mid-December, a guard posted by one of the gangs on a forest road accosted me and accused me of spying for the police. Fists flew and we scuffled when the man learned that I was a journalist inquiring about smuggling routes.

Since the business is highly profitable it is no wonder that two gangs clashed in November over control of the smuggling roads, said Camil Hubic, a magistrate in Novi Pazar.

Hubic is in charge of investigating the November incident, in which Marko Patric, 28, was murdered and the police found 20 spent cartridges of various calibres, a Scorpion pistol, radios, four passenger vehicles and two lorries loaded with diesel fuel and food products at the scene of the crime.

Hubic described the crime scene as “a battlefield where ‘two armies’ clashed”.

Sandzak is turning into a place where crime is common but legal investment is increasingly rare, he complained.

Sandzak is a remote region at the junction of three borders: Serbia, Montenegro and Bosnia and Herzegovina. Its proximity to the administrative border between Serbia and Kosovo has turned it into a magnet for smugglers of all sorts.

Macedonia part of human organs trafficking

The human organs trafficking is on the rise in the east-European countries, including Macedonia, says the latest report of the American Medical Association.

Organ harvesting operations flourish in Turkey, Moldova and Byelorussia, followed by
Macedonia, Russia, Romania, Bosnia, Albania, Kosovo and other east European countries.

A practice of traveling to east Europe for so-called “transplant tourism” has functioning for a while now, the American Medical Association said.

According to the same source, Macedonia, Bulgaria, Kosovo and the region of the former Yugoslavia are the most common destination of this kind of “tourism”.

The most demanded organs include kidneys, lungs, liver, heart valves and even skin

The image of Bosnia and an overdue U-turn

In early November, we published a discussion paper on the recent political crisis in Bosnia: Worst in Class . There was press coverage in Bosnia and internationally . We received direct feedback from policy makers, including foreign ministers, from across Europe. In our last newsletter we had recommended:

“As a way out of the current crisis a transparent debate on all aspects of police reform is required. In the meantime, we urge the EU to rethink its policy of holding up the signature of an SAA with Bosnia over an issue where Bosnia has made significantly more progress than many of its neighbours, including Serbia.”

On 4 December, EU Enlargement Commissioner Olli Rehn visited Bosnia to initial a Stabilisation and Association Agreement. A recent article by Birn – Bosnia’s Leaders Discover the Joys of Compromise – noted:

“The two archrivals, Bosniak member of the BiH Presidency and leader of the Party for BiH, SBiH, Haris Silajdzic, and RS Premier and head of the SNSD, Milorad Dodik, substantially modified their positions and toned down their rhetoric. For its part, the EU seems to have dropped its insistence on a unified BiH police service. The EU’s new stance appears to reflect an argument put forward in a recent report by the European Stability Initiative (ESI), a think-tank which specializes in Balkan issues.

In its report, the ESI argues that former High Representative Paddy Ashdown and his EU partners mismanaged police reform in Bosnia and increased political tension by insisting on only one out of several possible options for the reorganization of the police service. The EU appears to have taken advantage of the resolution of the latest political crisis by giving credence to vague but positive statements on police reform which have been made by representatives of the ruling coalition and by modifying its own position. EU policy is now based on allowing Bosnia’s leaders to find a common solution for police reform on their own.”

We are obviously very happy about this turn of events. This is an important step forward, both for Bosnia and for the EU. Now it is vital that the SAA with Bosnia is ratified in early 2008.

Return to Europe – the film

It is one of the most ambitious documentary film projects undertaken on the Balkans in recent years: Erste Stiftung, Austrian broadcaster ORF and German-Swiss-Austrian channel 3sat are funding a ten-part documentary series on the Balkans, based on ESI research. You can check out the 4 minute Trailer - Return to Europe .

Under the theme Return to Europe , ESI researchers and five Austrian film directors are traversing the region, from Albania to Istanbul. The series will be shown on Austrian, German and Swiss TV from April 2008.

Tirana locals block a new road

People in one neighborhood of the Albanian capital oppose infrastructure improvements that would encroach on their property. Are they justified?

Property rights, a political party founded by journalists, and mistreatment at foreign airports are among the topics on the minds of Albanian bloggers this week.

Writing at peshkupauje, Blendi criticises the residents of one Tirana neighborhood, who have been blocking infrastructure projects that would encroach on their property.

“It is normal that those who have children will want also a road in order for them to go to school, will want to go very fast to the doctor when they need to, and also to go out into their city,” he writes. The residents “know that the benefits of a road are more valuable than a thousand kitchen gardens” yet “the intervention of the state, even for a new road, seems to them threatening.”

Such recalcitrance hides a dirty secret, Blendi suggests: “They are not legal owners. With their disobedience, they hope to cover the fact that they built on land that wasn’t theirs.”

The law should be applied firmly, comments Perparimi, saying otherwise “they will do their best to expand their property even more by moving the fence.”

At shekulli, Gezimi is concerned about a new party formed by journalists who say their rights have been denied. Prime Minister Sali Berisha has recognised the new party, but Gezimi wonders if it’s a good idea to blur the boundaries between the media and politics.

“Is it right for journalists to start a political party?” he asks. “The journalists, oh Mr. Prime Minister, create newspaper articles not political parties. And how can we speak about journalists that are being censored by all the owners at the same time? In Tirana there are enough journals and television stations that each person who publishes in one journal can find a place at another that has a totally different mentality. And even if he doesn’t find it at those two, there are still at least 100 others on the list.”…………………

(Eigener Bericht) - Kurz vor Weihnachten bekräftigt der Vatikan unter der Leitung des deutschen Papstes seine Zustimmung zu der bevorstehenden Sezession des Kosovo. Wie einflussreiche Angehörige des katholischen Klerus erklären, könne “mit der Unabhängigkeit” der südserbischen Provinz “eine neue Phase” der “Ordnung” für das Armutsgebiet beginnen. Zugleich intensiviert der Kirchenstaat seine Aktivitäten im angrenzenden Albanien und nutzt - wie Berlin - albanische Kräfte zur Brechung des serbischen bzw. serbisch-orthodoxen Einflusses. Die Zusammenarbeit zwischen der Bundesrepublik und dem Vatikan beim Ausbau ihrer Positionen in Südosteuropa folgt alten Traditionen, die den gemeinsamen Kampf gegen die Versailler Friedensordnung ebenso beinhalteten wie Angriffe auf die Friedensordnung von 1945. “Der Vatikan hat das Europa von Versailles gehasst, genauso wie das von Jalta und Potsdam”, urteilt die französische Historikerin Annie Lacroix-Riz im Gespräch mit dieser Redaktion; “er meinte, dass ganz Mittel- und Osteuropa dem Reich zu Recht zustand”. Die Kurie unterstützte die deutsche Revisionspolitik nicht nur in der Zwischenkriegszeit, sondern auch nach dem Zweiten Weltkrieg und arbeitet ihr bis heute zu. Jüngste Beispiele sind offener Zuspruch für die deutschen “Vertriebenen”-Verbände und die Förderung der Zerschlagung Jugoslawiens.

“Die einzige Option”

Wie einflussreiche Angehörige des katholischen Klerus erklären, gebe es keinen Weg an der Sezession des Kosovo vorbei. “Mit der Unabhängigkeit” der südserbischen Provinz könne “eine neue Phase” beginnen; die UNO sowie die EU müssten “das Land zu einer Ordnung führen, zu ausreichender wirtschaftlicher, sozialer und politischer Autonomie”, heißt es in diesen Tagen bei Radio Vatikan.[1] Der katholische Bischof in Prizren hatte bereits im Mai mitgeteilt, er halte die Abspaltung des Kosovo für die “einzige Option”. Sollte sie verweigert werden, sei neuer Krieg unausweichlich.[2] Der Vatikan, der offene Stellungnahmen des Papstes zu dem Thema bislang noch verweigert, positioniert sich damit unmissverständlich auf Seiten der Berliner Außenpolitik. Dies gilt auch für seine internationale Gesprächsdiplomatie: Zur konkreten Lagebesprechung hat Benedikt XVI. Anfang Dezember den albanischen Staatspräsidenten Bamir Topi empfangen.

“Zurück zu den Wurzeln”

Ebenso wie Deutschland setzt auch der Kirchenstaat seit den 1990er Jahren in Südosteuropa auf albanische Kräfte. Ziel ist es, die eigene Machtbasis - den katholischen Bevölkerungsteil - zu stärken und Einfluss gegenüber der konkurrierenden (serbisch-)orthodoxen Kirche zu gewinnen. Dazu intensiviert Papst Benedikt XVI. die Kooperation mit Albanien. Bereits sein Amtsvorgänger Johannes Paul II. hatte 1992 diplomatische Beziehungen zu Tirana aufgenommen und 2002 ein Abkommen über die Regelung der Kontakte geschlossen. Sein Nachfolger hat Anfang Dezember einen weiteren bilateralen Vertrag unterzeichnet, mit dem wirtschaftliche und finanzielle Fragen geklärt werden. Hintergrund sind Forderungen, die Regierung in Tirana solle den zu realsozialistischen Zeiten verstaatlichten Kirchenbesitz rückübertragen. Außerdem sucht der Vatikan den katholischen Bevölkerungsanteil zu vergrößern. Gegenwärtig gehören rund zehn Prozent der Albaner der römischen Kirche an. Die Apostolische Administratur Prizren zählt rund 65.000 Katholiken im Kosovo, will jedoch erkannt haben, dass “viele Moslems, deren Vorfahren unter osmanischer Herrschaft offiziell zum Islam übergegangen, insgeheim aber Christen geblieben waren, (…) zu ihren Wurzeln zurückkehren” wollten.[3] Damit steigt der Einfluss des Vatikan in der Region.

Zerschlagung Jugoslawiens

Ein Paradebeispiel für die Kontinuität der deutsch-vatikanischen Revisionspolitik bieten die Bemühungen um die Zerschlagung Jugoslawiens. Die Kurie kooperierte bereits während des Zweiten Weltkrieges eng mit dem kroatischen Ustascha-Regime; Alojzije Stepinac, seit 1937 Erzbischof von Zagreb, galt als eine der wichtigsten Figuren des faschistischen Kroatien und deckte schwerste Verbrechen. Nach dem Krieg blieb er trotz einiger Jahre Gefangenschaft ein enger Parteigänger der Bundesrepublik und der Vereinigten Staaten. Der Vatikan, der sich bereits an der Zerschlagung des ersten, in den Pariser Friedensverträgen begründeten jugoslawischen Staates beteiligt hatte, organisierte “in aller Ruhe die Umsturzaktivitäten in den katholischen Zonen” des zweiten, 1945 wiedererstandenen Jugoslawien, berichtet Annie Lacroix-Riz.[10] Zu Beginn der 1990er Jahre hatte die Subversion schließlich Erfolg: Kroatien erklärte sich, wie auch Slowenien, für unabhängig - und wurde von Deutschland, Österreich und dem Vatikan trotz massiver Widerstände zahlreicher anderer Staaten anerkannt.

Schon 1946

Die Niederlage kassierte neben Belgrad ein Staat, der die Versailler Friedensordnung und später die Friedensordnung von 1945 vergeblich zu verteidigen versucht hatte: Frankreich. Für Beobachter mit guten Kenntnissen der vormaligen Geschehnisse war die Entwicklung voraussehbar. “Die französische Diplomatie”, berichtet Annie Lacroix-Riz im Gespräch mit dieser Redaktion, hatte bereits 1946 bei neuen Operationen des Vatikan in Kroatien “ganz deutlich die Perspektive der (zweiten) Zerstörung Jugoslawiens erkannt”.[11]
